Liability & Refund Policy

By purchasing and registering for a Fitness Comps Co. competition, athletes acknowledge that this athletic fitness event is hosted online, and is an extreme test of a person's physical and mental limits. This carries with it, inherent and potential risks. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of the event, lack of hydration, death, serious injury and property loss. For the avoidance of doubt, this Waiver and Release shall be effective and applicable at all times during competition participation in any and all FitnessComps competitions.

Participant Representations: by purchasing and registering for a Fitness Comps Co. competition and by agreeing to the Liability & Refund Policy, athletes represent and acknowledge that (i) They are in good health and physically fit to participate in the Fitness Comps Co. Event, (ii) They have not been advised against participating in the Event by a qualified health professional and (iii) They are not under the influence of alcohol or any illicit or prescription drugs which would in any way impair their ability to safely participate in this Fitness Comps Co. Event. The athlete agrees it is their sole responsibility to determine whether they are sufficiently fit and healthy enough to participate in the Fitness Comps Co. Event. The athlete also agrees to be familiar with and to abide by any rules and regulations established for the Fitness Comps Co. Event.

I provide an irrevocable license to Fitness Comps Co. and its officers, employees, agents, assignees, licensees, and transferees to use all photographs, pictures, videos, images, and other media submitted by me to Fitness Comps Co. (the “Media”) and publish all Media in any and all forms and in all manners including composite images or distorted representations, for the purposes of publicity, illustration, commercial art, advertising, publishing (including publishing in electronic form on CDs or internet websites), for any event, product or service offered by Fitness Comps Co., but not for any other purpose.

By purchasing and registering for a Fitness Comps Co. competition, the athlete waives any rights to further compensation in relation to the use of the Media and acknowledges and agrees that they shall have no further rights to remuneration in connection with the use of the Media by Fitness Comps Co. and its officers, employees, agents, assignees, licensees, and transferees in accordance with these terms:

The athlete represents and agrees to Fitness Comps Co. and its officers, employees, agents, assignees, licensees, and transferees that they are the sole individual who holds copyright in the Media, and that consent is not required by any other party with respect to the use of the Media;

The athlete remises, releases and forever discharges Fitness Comps Co. and its officers, employees, agents, assignees, licensees, and transferees from all actions, causes of action, suits, debts, duties, accounts, bonds, covenants, contracts, claims and demands whatsoever in relation to the Media which the athletes now has or hereafter can, shall or may have for or by reason of or in any way arising out of any cause, matter or thing relating to the use of the Media in accordance with these terms; and

There will be no refunds.

Substitutions are allowed prior to the start of the event.
